City to discuss abandoned cemetery

The Atlantic city council is expected to discuss issues related to the Southlawn Memorial Gardens Cemetery.

For the past several months county officials have been trying to figure out who was responsible for maintaining the property.

The property, which had been annexed by the city some time ago, is owned by the Jean Broderson estate, and volunteers who have been helping maintain the property, although officials say it is not an active cemetery.

Last month Cass County Attorney Dan Feistner had asked the Iowa Insurance Division for an opinion who said Southlawn “didn’t seem to be an operating cemetery.”

Feistner said he asked officials what the division’s legal opinion was regarding who would have responsibility for taking care of the property. He told the supervisors that he was told that the City of Atlantic would have the responsibility to preserve and protect the property as a cemetery, citing an amendment to Iowa Code.

City officials have been looking into the issue, and City Attorney Brian Daiker is expected to report to the council tonight.

The meeting is open to the public and will begin at 5:30 p.m. in the council chambers.
